TERMS OF SERVICE

1. Introduction

Welcome to Barabar ("App"). The App is operated by Barabar Labs, a Sole Proprietorship based in Gurugram, India ("we," "us," or "our"). By accessing or using our App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not use the App.

2. The Service

Barabar is a bill-splitting and expense-tracking platform. We facilitate information sharing regarding debts between users. We are not a bank, NBFC, or payment gateway. We do not hold your funds. All UPI transactions are processed directly between users via third-party UPI apps (e.g., Google Pay, PhonePe).

3. Data Ownership & Commercial Use

Ownership: You agree that while you retain rights to the raw data you input (e.g., expense amounts), any data generated, derived, processed, or aggregated by Barabar Labs ("App Data") is the exclusive property of Barabar Labs. This "App Data" includes but is not limited to: your repayment timelines, average monthly debt, social graphs, and proprietary "Trust Scores".

License to Use: You grant Barabar Labs a worldwide, perpetual, irrevocable, royalty-free license to use, analyze, and monetize your data for any lawful purpose, including but not limited to: calculating creditworthiness, generating leads for financial products (e.g., credit cards, loans), and improving our algorithms.

4. User Accounts & OTP

You must provide a valid Indian mobile number to use the App. You agree to receive One Time Passwords (OTP) via SMS for verification. You are responsible for maintaining the confidentiality of your account.

5. Prohibited Conduct (IT Act Compliance)

You agree not to host, display, upload, modify, publish, transmit, store, update, or share any information that:

We reserve the right to ban any account permanently without notice if we suspect any violation of these terms.

6. Intermediary Status

Barabar is an "intermediary" as defined under the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Our role is limited to providing a platform for users to record and track expenses. We do not initiate the transmission, select the receiver of the transmission, and do not select or modify the information contained in the transmission.

7. Limitation of Liability (The "Kill Switch")

PLEASE READ CAREFULLY: To the maximum extent permitted by applicable law, in no event shall Barabar Labs or its proprietor, Snehal Mishra, be liable for any indirect, punitive, incidental, special, or consequential damages, including damages for loss of use, data, or profits. Our total liability to you for any claim arising out of these terms is limited to the amount you paid us to use the service or ₹100 (Indian Rupees One Hundred), whichever is lower.

8. Indemnification

You agree to indemnify and hold harmless Barabar Labs and its proprietor from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

9. Amendments and Modifications

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

10. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

11. Force Majeure

Barabar Labs shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Barabar Labs' reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation (including "line-noise" interference).

12. Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Gurugram, Haryana.
