Welcome to Barabar ("App"). The App is operated by Barabar Labs, a Sole Proprietorship based in Gurugram, India ("we," "us," or "our"). By accessing or using our App, you agree to be bound by these Terms and our Privacy Policy. These Terms are governed by applicable Indian law, including the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Personal Data Protection Act, 2023 ("DPDP Act"). If you disagree with any part of these Terms, please do not use the App.
Barabar is a bill-splitting and expense-tracking platform. We facilitate information sharing regarding debts between users. We are not a bank, NBFC, or payment gateway. We do not hold your funds. All UPI transactions are processed directly between users via third-party UPI apps (e.g., Google Pay, PhonePe).
Ownership: You retain ownership of the personal data you provide (e.g., your name, phone number, expense amounts). Barabar Labs processes this data solely for the specific purposes described in our Privacy Policy and these Terms.
Licence to Process: By creating an account and accepting these Terms, you grant Barabar Labs a non-exclusive, revocable licence to process your personal data for the following specified purposes only:
We will not process your personal data for any purpose beyond those listed above without first providing you with notice and, where required by the DPDP Act, obtaining your separate, specific consent.
Giving Consent: By creating an account, you explicitly confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. We record the date, time, IP address, and version number of both documents at the moment you accept them, as required by the DPDP Act, 2023.
Withdrawing Consent: You may withdraw your consent to the processing of your personal data at any time by deleting your account or by contacting our Grievance Officer at grievance@barabar.co.in. Withdrawal of consent does not affect the lawfulness of any processing carried out before the withdrawal. Upon withdrawal, we will cease processing your data for non-essential purposes; however, we may retain certain data as required by law (e.g., for tax compliance, fraud prevention, or anti-money laundering obligations) — details are set out in the Privacy Policy.
You must provide a valid Indian mobile number to use the App. You agree to receive One Time Passwords (OTP) via SMS for verification. You are responsible for maintaining the confidentiality of your account. Use of the App is restricted to individuals aged 18 and above; we verify your age at registration through your date of birth.
You agree not to host, display, upload, modify, publish, transmit, store, update, or share any information that:
We reserve the right to suspend or permanently ban any account without notice if we suspect any violation of these Terms.
Barabar is an "intermediary" as defined under the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Our role is limited to providing a platform for users to record and track expenses. We do not initiate the transmission, select the receiver of the transmission, and do not select or modify the information contained in the transmission.
In the event of a personal data breach that is likely to result in harm to you, we will notify affected users and report to the Data Protection Board of India as required under the DPDP Act, 2023. We will take all reasonable steps to contain, investigate, and remediate any breach and will communicate relevant information to you without undue delay, including the nature of the data affected and the steps you should take to protect yourself.
As a Data Principal under the DPDP Act, 2023, you have the right to access, correct, and erase your personal data, to withdraw consent, to have your grievances addressed, and to nominate a person to exercise your rights on your behalf. PLEASE READ CAREFULLY: To the maximum extent permitted by applicable law, in no event shall Barabar Labs or its proprietor, Snehal Mishra, be liable for any indirect, punitive, incidental, special, or consequential damages, including damages for loss of use, data, or profits. Our total liability to you for any claim arising out of these Terms is limited to the amount you paid us to use the service or ₹100 (Indian Rupees One Hundred), whichever is lower.
You agree to indemnify and hold harmless Barabar Labs and its proprietor from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by push notification or in-app alert before the changes take effect, and by updating the version number and "Last Updated" date on this page. Your continued use of the App after such notice constitutes your acceptance of the revised Terms. The version number accepted at sign-up is recorded on your account.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
Barabar Labs shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Barabar Labs' reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation.
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Gurugram, Haryana.
